An order issued by Superior Court Judge Pro-Tem Robert Klitzkie to revoke amusement devices deemed as illegal gambling machines will stand. A five-page decision issued by Superior Court Judge Michael Bordallo denied Guam Music's motion to intervene in the case.
The company, one of the largest suppliers of Liberty Machines on Guam, was trying to intervene in the case filed by the Attorney General's Office against the Department of Revenue & Taxation. Judge Pro-Tem Klitzkie in August granted the Attorney General's request for petition of mandate, ordering DRT to revoke the licenses of specific gaming devices. Consequently, Guam Music claimed their due process rights were violated and that Klitzkie was not qualified to serve on the bench.
Judge Bordallo, however, denied both their motion to intervene and a motion to stay Judge Klitzkie's order.
Guam Music legal counsel Attorney Randy Cunliffe told KUAM News that he and his client plan on filing a new writ to reinstate these licenses.
