Federal court OKs dismissal of teacher case

Guam - The District Court of Guam has granted the motion to dismiss in a case filed by former Department of Education teacher Gabriel Lau against the agency. Lau filed a complaint asserting that he was wrongfully terminated from his position as a teacher at D.L. Perez Elementary School in 2008. Lau claimed his termination was without a justifiable cause, that the principal violated the family and medical leave act when she demanded he come into work despite is medical condition and that the principal created a hostile working environment.

The court found that the plaintiff failed to meet his burden of proving the court had federal question jurisdiction, therefore the case was dismissed.
